Who is responsible for data processing?

Ballon Media N.V., with registered offices at Franklin Rooseveltplaats 12, 2060 Antwerp and registered in the Crossroads Bank for Enterprises under the number 0425 148 327 (hereafter Ballon Media), acts as the data controller processing the personal data of its customers/contacts for the purposes described in this privacy policy notice.


This means that Ballon Media determines for what purpose and with what means the data are processed.
 

General

Ballon Media aspires to comply with its duties and to respect your rights when processing personal data. It is our goal to protect your privacy and private life. We want to inform you as well as we can and offer you as much control over your personal details as possible.

The information we collect, the reason why we collect it, how long we keep it, what your privacy rights are and how you can exercise them, is described below.

Before you use our website, app or products, we invite you to take the time to thoroughly read this privacy policy in order to find out which information we collect and how we use it.

We respect your privacy and have invested a lot of time and energy in the protection of your personal details. Our website, app and products are ‘GDPR proof’. Furthermore, we permanently try to improve the protection of your personal information.
 

Short introduction to the General Data Protection Regulation.

The General Data Protection Regulation (GDPR) is applicable since 25 May 2018 and governs your rights regarding your personal data. This regulation, the law of 13 June 2005 (the Electronic Communication Law) and the related implementing decrees, as well as any future alterations of this regulation, law or implementing decrees, govern the protection of your personal details. The most important concepts of this new regulation (often called GDPR) are ‘person concerned’, ‘personal details’ and ‘processing’. The person concerned is you, the natural person visiting this website, using our services or buying our products. Your personal details are all the details concerning you: your name, your e-mail address, but also the details you communicate to us whenever you contact us, the information you send us in the contact sheets or your purchase history. Processing them is what we do with these personal details..
 

What does ‘data processing’ mean?

Processing personal data means collecting, recording, organising, storing, updating, changing, retrieving, consulting, using, spreading, archiving, deleting, combining, destroying... personal details.
 

Why do we process your personal details?

We process your personal details with the following goals in mind:

  • Send you our newsletter to inform you about Ballon Media’s (new) products and services
  • Follow up performances
  • Offer the best possible service
  • Process requests regarding our products and services
  • Meet our legal obligations
  • Follow up studies, tests and statistics
  • Customer and invoice management as well as all related services

On what legal basis do we process your personal details?

Every use of your personal details must have a legal basis. We process your details on the basis of our legitimate interest, your permission, the implementation of an agreement and the legal obligations.

We ask your permission for a number of things, e.g. to e-mail you our newsletters, but also to collect your personal details by all kinds of means. You have the right to withdraw your consent at any time. All you have to do is click on the “unsubscribe” button you will find in each of these e-mails. For Ballon Media, the main legal basis for collecting your personal details is your permission or consent.

Sometimes, we have a “legal obligation” to store your personal details, e.g. in a context of contractual liability or extra-contractual liability.

We also store details on the basis of our “legitimate interest”. This “legitimate interest” includes all the activities you, as a customer or as a contact, can imagine we, as a publisher, may need to do our job properly, e.g. direct marketing activities, fraud prevention, internal administrative purposes or ensuring the security of our network and information systems. In the latter case, we will always strive for a good balance between the security of these systems and respecting the privacy of the person concerned.

Finally, we also need your personal details – identity, address and contact details – to live up to the agreement we have with you.
 

Which personal details do we store?

That depends on the type of relationship you have with us. Please find the different types of relationships below. We call them categories of data subjects.  
 

Relationship Description
NON-CUSTOMER The natural person who visits our website without identifying himself and who does not leave his personal details;
The natural person who uses our non-binding services (a person who registers for one of our newsletters, fills out a contact form...);
The natural person whose personal details we collect by means of different channels (such as contests, sales promotions, special sales, websites, apps...).
 
CUSTOMER The natural person who, via one of our websites, purchases our products or uses our services.
 
BUSINESS CUSTOMER The staff members of a business customer with whom we work and keep in touch.

 
Below, you will find an overview (per category of data subject) of how we process your personal details, whether you can object to this, and what the consequences are. We also give an overview of your rights as a data subject.
 

Which personal details of a non-customer do we process?

When you do not leave any personal details when visiting our website, we will not store any. Depending on the settings of your browser, it is possible that cookies are stored on your device. See our cookie policy below.

Some of our services are non-binding, e.g. the newsletter, filling out and forwarding a contact form, contacting us by telephone, in person or by e-mail. In that case, we will store your e-mail address and other contact details you may communicate. These details shall be processed following your consent. Newsletters shall be sent as long as this consent has not been withdrawn. Personal details collected by means of a personal contact or contact form are stored for as long as necessary to ensure a good follow-up of the question and to draw up a contact history.

How do we obtain your personal details?
Through different channels, e.g. via contests, sales promotions, special sales, websites or apps, we can collect personal details of people who are not (yet) a customer or business customer.

We only collect non-customer details with the consent of the non-customer. Some additional data processing is done on the basis of our legitimate interest.

It is also possible that we obtain your personal details through a third party. In such a case, either this third party will inform you of the fact that your details have been transmitted to us, or we will by means of a mailing or when contacting you for the first time.

Newsletter
Ballon Media offers a newsletter service, for which the users can register. These newsletters contain the latest news, inform you of the planned events, and tell you all about our new products. The goal of our newsletter service is to inform anyone who might be interested in our products or services. Your e-mail address is added to the list of subscribers to the newsletter, which is kept up to date by Ballon Media. Every newsletter contains a link allowing you to unsubscribe. You may of course also send an e-mail to marketing@ballonmedia.com to unsubscribe.

You may at all times change or delete your details.

We will never communicate your subscriber details to any third parties without your prior consent.

If you registered for one of our newsletters, your details can also be used to keep you posted on Ballon Media’s new initiatives, sales promotions, actions and contests or new titles and products in our catalogue.

Website and apps
The personal details collected through our websites and apps are used for the following purposes: to draw up statistics and perform any type of analysis in order to improve the quality of our services and website content. If website users e.g. keep calling our customer service even if there is a “help” button with extra content on the page concerned, we will know for what type of data subject we have to improve our online services.
 

Which personal details of a customer do we process?

We store the contact and identity details of our customers (name, address, telephone number, e-mail address, invoicing details...). Our system also allows us to keep track of your purchase or browse history (the books or services you have looked up on our website). We do not store sensitive information. The legal basis for storing personal details is the implementation of the agreement. Keeping track of your purchase or browse history is done on the basis of our legitimate interest.
 

Which personal details of a business customer do we process?

In this case, processing personal details of business customers only matters if the business customer is a natural person. If the business customer is a legal person, the privacy policy only concerns the personal details of the staff members (mainly contact details) we process in the context of our relationship with the business customer. Your rights are described below. Please contact us should you need more information. We will be happy to provide it.
 

How long do we keep your personal details?

We store identity details for as long as reasonably necessary in the context of our relationship with the users. E-mails with inquiries are stored for as long as required, so we can answer or process them properly.

This will differ depending on the inquiry. We will store the details concerned for as long as needed to achieve the goal for which we collect them. Sometimes, your details can be stored for a longer period of time in order to meet legal requirements (e.g. invoicing details).

When the applicable retention period(s) has/have elapsed, these details are deleted or anonymised.
 

Selling or transmitting personal details to third parties:

We do not sell personal details to third parties.

With customer’s consent:

Information is given about the third party and the reasons why your personal data are being transmitted and processed. You will always receive an explicit notification.

When it is necessary for our services:

Some databases are accessible to third parties who are working for us. We always make sure these third parties keep your personal details safe and that they use them respectfully and with due care. In that respect the necessary processing agreements are drawn up.

Legal successors:

We can transmit your personal details to possible legal successors and associated companies of the Ballon Media group.
 

What are your privacy rights as a (non-)customer?

 

  1. Right of access:

At your request we will supply you with an overview of all your personal details we store. Should you need extra information, we can elaborate on the following:

  • Processing goals;
  • Retention period + criteria determining the length of this retention period;
  • Source if we receive your personal details from a third party.

  1. Right to rectification:

Should your details be inaccurate, incomplete, improper or obsolete, it is possible to rectify them. Feel free to notify us which data you would like to alter. It will allow us to keep your personal information up to date.  
 

  1. Right to delete your details. In the following cases, it is possible to have your personal details deleted:
  2. If your personal details are no longer required for the goals for which they have been collected or processed;
  • If your personal details have been processed wrongfully;
  • If your personal details have to be deleted in order to meet certain legal obligations;
  • If your personal details were collected when you were still a minor.

In some cases, we cannot delete all of your personal details. In such a case, we will give you more information in the reply to your request.
 

  1. Limitation of processing. You have the right to ask that the processing of your personal details is limited in the following cases:
  • If their accuracy is disputed;
  • If they have been processed wrongfully.

How can you exercise your privacy rights?

In order to exercise your right of access, you must prove your identity. This will allow us to prevent your personal details from being disclosed illicitly. Should there be any doubts concerning this identification, we will have the right to ask for extra details proving your identity.
 

When will you receive an answer?

We will send you a reply to your request as quickly as possible. You will receive an answer within a month. In extreme circumstances, the number of requests and the complexity of their answers can extend this period with another two months. In such a case, you will receive a notification.

A clear, understandable and accessible answer will be given to all of your requests.
 

Filing a complaint with the data protection authority

Should you have any complaints with regard to the processing of your personal details, you can file your complaint with the data protection authority. It goes without saying that, should you feel wronged in any way, you may of course contact us first. We will do everything we can to rectify such a situation.

These cookies are used on an aggregate level to draw up reports about the way visitors are using the websites. This allows Ballon Media to adapt its websites to the preferences of the users. Other third parties who can store cookies on your computer via our websites are the social media such as facebook, twitter or Google+. This happens when using the social media buttons on our websites (like or tweet).
 

Data security

We strive to protect your personal details and privacy, both in our offices and on Ballon Media’s network. We take organisational measures to protect your personal details. The protection, integrity and confidentiality of personal details are very important to us.

The members of our staff are trained to handle personal details correctly. In the case of privacy-sensitive projects we make a security and data protection assessment. We also take all kinds of technical measures to protect your personal details, e.g. passwords, antivirus software, access control for staff members, harddisk...

If Ballon Media refers to other sites of third parties (social media, organisers of events sponsored by Ballon Media, etc...), these sites do not fall under the area of application of our privacy policy. Read their privacy and data processing policies carefully.

If payment details are given, we use secure connections.
